1. About These Terms
Welcome to Routebook. These Terms of Service ("Terms") govern your access to and use of the Routebook mobile application and related services (collectively, the "Platform") operated by RouteBook LLC ("Routebook," "we," "our," or "us").
By creating an account, downloading the app, or using any part of the Platform, you agree to these Terms in full. If you do not agree, do not use the Platform.
Canada scope. These Terms apply to users whose Routebook account country is Canada, including users in Quebec. Your account country is set when you create your account (based on your device's region and store country at that time) and can be changed in your Profile at any time. These Terms are subject to the consumer-protection, language, privacy, and other mandatory laws that apply where you live. If a provision of these Terms conflicts with a non-waivable right under applicable law, that right prevails.
We may update these Terms from time to time. When we make material changes, we will notify you through the app or by email. Your continued use after notice constitutes acceptance of the revised Terms.
2. What Routebook Is — and Is Not
Routebook is a technology platform for discovery, communication, and coordination of cost-sharing carpool arrangements between users. It allows users to post travel routes, search for available routes, exchange messages with other users to coordinate long-distance travel arrangements, and coordinate their trip and settle agreed cost-sharing contributions through Routebook’s Stripe Connect payment flow.
Routebook:
- Provides tools for users to post, find, and discuss travel routes
- Provides in-app messaging for users to communicate directly with each other
- Facilitates eligible cost-sharing payments through Stripe Connect as described in Section 5.7; Stripe processes card payments and connected-account payouts, subject to availability and eligibility
- Does not provide, arrange, or contract for transportation services
- Does not employ, endorse, screen, or supervise any user
- Does not perform criminal record checks, driving record checks, or assess insurance coverage, vehicle condition, or licensing status of any user beyond the identity verification described in Section 5.6
- Does not guarantee the safety, reliability, or conduct of any user
- Does not guarantee that any trip will occur, be completed, or be as described
- Is not a transportation company, Transportation Network Services ("TNS") provider, Transportation Network Company ("TNC"), passenger transportation licensee, common carrier, motor carrier, taxi service, limousine service, broker, dispatch service, or agent for any user
Routebook is intended for genuine, non-commercial carpools: a Host offers available seats on a trip the Host independently plans to make, and Guests traveling in the same direction may coordinate to share that trip's costs. Carpool rules are set by each province and territory. Their requirements differ, and the legal treatment of a particular trip depends on what actually happens—not on the Platform's name or these Terms. For example, British Columbia's regulation defines a car-pool vehicle by reference to a qualifying return trip and limits the total contributions from all passengers to the operating costs attributable to that trip. Other jurisdictions have their own requirements.
Routebook applies a per-seat price limit in its posting and booking flows as an additional safeguard. The current limit is calculated using a Canadian per-kilometre benchmark and the route and seat information entered in the Platform. The limit may change as the Platform is updated. It is not a legal opinion, a calculation of a Host's actual expenses, or a guarantee that a trip complies with local law. Hosts remain responsible for ensuring that the combined contributions from all Guests do not exceed the costs permitted for their trip, and for meeting any other local conditions. In British Columbia, for example, the regulation's stated operating costs include gasoline, tolls, ferry fares, insurance, and maintenance, but exclude depreciation. Hosts must not use the Platform to offer trips for profit, on-demand transportation, or trips arranged primarily to carry paying passengers.
Routebook does require every user to complete a government-ID verification check, performed on our behalf by Persona Identities, Inc. through its Persona product, before that user may post a route or send a seat request. This check consists of a scan of a government-issued identity document combined with a real-time selfie that Persona compares against the photo on the document. The check confirms document authenticity and that the person submitting the check is the person shown on the document. It also enforces our minimum-age requirement: users whom Persona determines are under 19 years of age are automatically rejected and cannot use the Platform. Verification is a Platform access prerequisite only; it is not a background check, does not screen for criminal history, driving record, sobriety, insurance, or vehicle condition, and is not displayed as a badge to other users. See Section 5.6 for the full operational details.
When users choose to travel together, they do so entirely at their own discretion and risk. Routebook has no involvement in, control over, or responsibility for the actual conduct of any trip arranged through the Platform. Routebook does not hold itself out as a party to the travel arrangement itself and facilitates payment of agreed cost-sharing contributions through Stripe Connect as described in Section 5.7.
3. Eligibility
3.1 Baseline Requirements
To use Routebook in Canada you must:
- Be at least 19 years old (Routebook applies a single pan-Canadian minimum age of 19 to cover the age-of-majority threshold in every Canadian province and territory, including British Columbia, New Brunswick, Nova Scotia, Newfoundland and Labrador, Yukon, the Northwest Territories, and Nunavut)
- Be a resident of a Canadian province or territory
- Have the legal capacity to enter into a binding contract under the laws of your province or territory of residence
- Not be barred from using the Platform under applicable law
- Provide accurate and complete registration information, including a legal name and a Canadian mobile phone number
- Provide a government-issued identity document when we ask for it, through the Persona verification flow described in Section 5.6
3.2 Safety Representations
Because Routebook is used to arrange travel between strangers, community safety is a condition of access. You represent, warrant, and covenant — at registration and every time you use the Platform — that none of the following is true of you:
a. You have ever been convicted of, or pled guilty or no contest to:
- any sexual offence — including sexual assault, sexual interference, invitation to sexual touching, sexual exploitation, child pornography, or any offence that requires registration under Canada's Sex Offender Information Registration Act (S.C. 2004, c. 10) or the sex-offender registry of any Canadian province or any other jurisdiction;
- any offence against a child or vulnerable person;
- any homicide offence — murder, manslaughter, criminal negligence causing death, or dangerous driving causing death;
- any terrorism-related offence under the Criminal Code of Canada or offence involving human trafficking, smuggling, or exploitation;
b. In the past seven (7) years, you have been convicted of, or pled guilty or no contest to:
- any indictable offence under the laws of Canada or any other jurisdiction not already covered by paragraph (a);
- any offence of violence — including assault, assault causing bodily harm, assault with a weapon, uttering threats, criminal harassment, stalking, kidnapping, forcible confinement, or robbery;
- any offence involving the unlawful possession, use, or trafficking of a weapon or prohibited device;
- any offence involving fraud, theft, identity theft, forgery, or breach of trust;
- any offence involving the production, trafficking, or importation of a controlled substance under the Controlled Drugs and Substances Act;
- any offence of impaired operation, dangerous operation, refusal to provide a breath or bodily substance sample, or driving while prohibited (if you use the Platform to offer rides);
c. You currently appear on any sex-offender registry (including the National Sex Offender Registry or any provincial registry), the OSFI Consolidated Sanctions List, the Public Safety Canada Listed Terrorist Entities, any list of persons subject to Canadian economic sanctions under the Special Economic Measures Act or the United Nations Act, or any outstanding warrant for arrest in any jurisdiction;
d. You are currently subject to a peace bond, probation order, recognizance, protective order, restraining order, no-contact order, or similar court order arising from any offence described in (a) or (b);
e. Your driver's licence is suspended, prohibited, revoked, or restricted in any way that would make it unlawful for you to operate a motor vehicle in your province or territory (if you use the Platform to offer rides).
3.3 Ongoing Duty to Disclose
If any of the representations in Section 3.2 becomes untrue at any time while your account is active, you must immediately stop using the Platform and notify us at the contact address in Section 15.5. Continued use after any such change is a material breach of these Terms.
3.4 Identity Verification and Background Checks
Routebook currently requires every user to complete a government-ID verification check via Persona before posting a route or sending a seat request. The operational details of that check are described in Section 5.6. By registering, you authorize Routebook and its agents (including Persona) to conduct that check, and you further authorize Routebook and its agents — directly or through third-party service providers — to conduct at any time additional checks including driver abstract and motor-vehicle-record checks, criminal-record checks (including Canadian Police Information Centre or "CPIC" checks and Vulnerable Sector Checks obtained through local police services), sex-offender-registry checks, and sanctions-list screening. You agree to cooperate with any such check, including providing accurate personal information, any required written consents, and access to any additional documents we reasonably request. Refusal to cooperate with any required check is grounds for immediate account termination.
Any collection, use, or disclosure of your personal information in connection with such a check will comply with the Personal Information Protection and Electronic Documents Act (PIPEDA) and any applicable provincial private-sector privacy legislation (including the British Columbia Personal Information Protection Act, S.B.C. 2003, c. 63, and the Alberta Personal Information Protection Act, S.A. 2003, c. P-6.5). Our use of any criminal-history information is further constrained by the Canadian Human Rights Act and each province's Human Rights Code, which limit the use of pardoned or non-conviction records.
Routebook is not obligated to perform any check beyond the Persona verification described in Section 5.6, and does not represent that any additional check has been performed on any user, including yourself. Where a check has been performed, no check is exhaustive, and passing a check does not warrant that a user is safe.
3.5 Termination for Ineligibility
We may — at our sole discretion, without notice — suspend or permanently terminate your account and remove you from the Platform if we determine or reasonably suspect that you do not meet the requirements of Sections 3.1–3.2, that you provided false or misleading information in connection with these requirements, or that your continued presence on the Platform presents a safety risk to other users. Where permitted by law, we may also cooperate with law enforcement, share information related to suspected violations with the appropriate authorities, and take any other action we consider necessary to protect the community.
Nothing in this Section 3 limits any other right we have to remove you or refuse service for any reason permitted by applicable law.
4. Accounts
4.1 Registration
You must create an account to access most Platform features. You agree to:
- Provide accurate, current, and complete information
- Keep your account information up to date
- Maintain control of the Canadian mobile phone number used to register the account
- Notify us immediately of any unauthorized access to your account
Routebook does not verify the accuracy of self-entered profile information other than the government-ID verification performed by Persona (see Section 5.6). You are solely responsible for the content of your account profile.
4.2 One Account Per Person
Accounts are personal and non-transferable. You may not create or maintain more than one account, operate an account on behalf of another person without disclosure, or use automation to create or manage accounts.
4.3 Phone Number Authentication
Account creation and every subsequent sign-in require you to verify possession of a working mobile phone number in the +1 North American Numbering Plan format (an E.164-formatted number with the country code +1). Phone verification is performed on our behalf by Firebase Authentication, a service provided by Google LLC. When you sign in, your phone number is transmitted to Firebase, Firebase sends a one-time verification code to that number by SMS, and once you enter the code back into the app Firebase returns an authentication token to us. Routebook stores your phone number and a cryptographically derived credential used to attach your Firebase-authenticated session to your Routebook account; Routebook does not store any password you type, because there is no password to type. You are responsible for maintaining control of the SIM/eSIM associated with your registered phone number; loss of control of that number can result in loss of access to your account. Your phone number does not determine your account country; account country is set separately as described in Section 1 and can be changed in your Profile.
4.4 Account Termination
We may suspend or terminate your account at any time, for any reason or no reason, with or without notice. You may delete your account at any time through the app settings. On deletion, we will delete or anonymize your personal information within 30 days, subject to the retention exceptions described in our Privacy Policy.
5. Platform Features
5.1 Route Posting
Users may post descriptions of travel routes they are driving, including departure location, destination, date or schedule, and the number of available seats. Routebook does not verify any information contained in a route posting. Route postings are user-generated content and Routebook makes no representation about their accuracy, availability, or the identity of the person who posted them.
Any amount shown in a route posting is a proposed cost-sharing contribution set by the Host. Routebook applies a per-seat limit in its product, but that limit is only an additional safeguard: it does not verify the Host's expenses or establish that the combined contributions for a trip are lawful. Hosts must set and accept only contributions consistent with the actual costs and requirements applicable to their trip. Guests should confirm the proposed route, timing, pickup and drop-off arrangements, available seat, and contribution with the Host before agreeing to travel.
Hosts must post only trips they independently intend to make, with a route, date, and schedule that reflect their own plans. Do not post speculative trips, accept requests that change the trip into on-demand transportation, or use the Platform to provide transportation for profit.
5.2 Route Search and Discovery
Users may search for posted routes by origin, destination, and date. Search results are provided for convenience only and do not constitute an endorsement of any route or user.
5.3 Invitations
Users may send and receive invitations to coordinate travel. An invitation is a communication feature only — it is not a contract, booking, or guarantee of transportation. Routebook is not a party to any arrangement made through the invitation feature.
5.4 Messaging
Routebook provides in-app messaging so users can communicate directly with each other. Users coordinate travel details and agree on any cost-sharing contribution. Eligible payments made through Routebook are processed by Stripe under Section 5.7; Routebook is not a party to the travel arrangement. Messages may not be monitored in real time. You agree to use messaging in compliance with these Terms and our Community Guidelines.
5.5 Requests, Acceptance, Changes, and Cancellations
A Guest's seat request, a Host's acceptance, an invitation, or a message records activity in the Platform and helps users coordinate. It does not mean Routebook books or provides transportation, processes a contribution, or guarantees that a trip will take place. The request and acceptance may form or evidence a travel arrangement directly between the Host and Guest; Routebook is not a party to that arrangement.
Hosts and Guests are responsible for promptly telling one another if they need to change or cancel an arrangement, including a change to the route, time, pickup point, or drop-off point. A Guest should not assume a material change is accepted unless the Guest agrees to it. Payments made through Routebook are subject to the Cancellation Policy, and eligible refunds are processed through Stripe. Users remain responsible for promptly communicating about trip changes, cancellations, and no-shows. Routebook may record request or cancellation activity, review reports, remove content, or restrict accounts under these Terms and our Community Guidelines; doing so does not make Routebook a party to the travel or payment arrangement.
5.6 Identity Verification
Before you may post a route or send a seat request, you must complete an identity verification session powered by Persona, a service provided by Persona Identities, Inc. There are two tiers:
- General verification (required to send a seat request): you submit any government-issued identity document — a driver's licence, Canadian passport, or provincial photo identity card — along with a real-time selfie. Persona extracts the data on the document and compares the selfie against the document photo.
- Host-tier verification (required to post a route): you must specifically submit a Canadian provincial or territorial driver's licence (rather than a passport or photo ID card), together with the same selfie match.
In both tiers, if Persona determines from the document that you are under 19 years of age, your verification is automatically rejected as ineligible and your submitted document images are redacted from Persona as soon as the age determination is made. You will not be able to complete registration or use the Platform. Users who pass verification may be re-verified from time to time and may be required to complete a fresh Persona session before continuing to use the Platform.
When Persona returns a successful verification result, the profile name on your Routebook account is automatically overwritten to match the full name reported on your government ID, so that your displayed name on the Platform equals your legal name. If you object to your legal name being displayed to other users, do not complete verification.
Your government-ID document images and biometric selfie data are transmitted directly to Persona and are processed and retained by Persona under Persona's own privacy policy and retention policy. Routebook does not receive or store your ID document images or biometric templates. Routebook receives only the verification outcome (verified, requires input, canceled, or age-ineligible), the document type submitted, and the name and date of birth extracted from the document. You may request Persona to redact the identity data associated with your verification session at any time — see our Privacy Policy for details.
Verification confirms identity — it does not screen for criminal history, driving record, sobriety, insurance, or vehicle condition. Verification is not an endorsement or guarantee of safety. Routebook reserves the right to revoke Platform access at any time based on verification outcome or otherwise, in its sole discretion.
5.7 In-Platform Payments in Canada
For paid rides in Canada, Guests pay the Host’s posted cost-sharing contribution through the Platform. Stripe processes the payment, and Stripe Connect is used to transfer eligible payouts to Hosts. Canadian payment amounts are denominated in Canadian dollars (CAD). The contribution and Routebook fees are displayed before the Guest confirms payment. Routebook does not provide transportation or guarantee that a trip will occur.
Stripe receives and processes payment-card information under its own terms and privacy policy. Routebook does not receive or store full card numbers or security codes. Hosts must complete Stripe Connect onboarding and meet Stripe’s requirements to receive payouts. Payment cancellation and refund handling are described in the Cancellation Policy.
Each user remains responsible for determining and reporting any tax consequences applicable to them. Routebook does not provide tax advice or make representations about the tax treatment of a contribution.
6. User Conduct
6.1 When You Offer a Ride
If you use the Platform to post a route or otherwise offer to carry another user in your vehicle, you represent and warrant, at all times you offer or provide such a ride, that:
a. you hold a valid, unexpired driver's licence issued by the province or territory in which you will be operating your vehicle, in a class appropriate for the vehicle you will be driving;
b. the vehicle you will use is currently registered, currently plated, in safe operating condition, and meets all applicable mechanical, inspection, and equipment requirements under the Highway Traffic Act (or equivalent statute) of the province or territory in which you will be operating it;
c. you maintain valid automobile liability insurance at or above the minimum coverage required by law in the province or territory in which you will be operating your vehicle, covering both the vehicle you will use and any other user you transport in it. You are responsible for confirming your coverage is in force and applies to your use of the Platform;
d. you have disclosed to your automobile insurer any use of your vehicle for carpooling or cost-sharing arrangements, and you have confirmed in writing (or obtained an endorsement to confirm) that such use is not excluded from coverage under your policy. You understand that personal automobile insurance policies in Canada may exclude coverage when a vehicle is used to carry others for any form of compensation, including a cost-sharing contribution, and that the Insurance Bureau of Canada and provincial regulators treat the question of whether personal-policy coverage applies to a given cost-sharing arrangement as fact-specific and carrier-dependent. You are solely responsible for ensuring your policy provides coverage for your use of the Platform. See Section 6.1.1 for additional guidance;
e. no legal, medical, or personal condition impairs your ability to safely operate a vehicle at the time of any ride; you are not impaired by alcohol, cannabis, or any other substance; and you comply with all applicable laws governing fitness to drive;
f. any amount you request or accept is a genuine contribution toward the costs of a trip you independently planned, and the combined contributions from all Guests do not exceed the amount permitted under the laws that apply to that trip. Routebook's per-seat price limit is an additional product safeguard; it does not calculate your actual expenses or determine whether the combined contributions comply with local law. You must not request or accept an amount that would turn your trip into a commercial or for-profit transportation service. An amount above the Platform's limit may not be posted or booked through Routebook;
g. the trip you have posted is one you would take regardless of whether any other user requests or books a seat. Your route on the Platform reflects a personal trip you are already making — you are not being dispatched, hired, or induced to make the trip by any user or by Routebook.
You further acknowledge that Routebook does not verify any of the foregoing and does not provide any insurance, coverage, or indemnification for you, your vehicle, or any other user in your vehicle. Breach of any representation in this Section 6.1 is a material breach of these Terms and subjects you to the full indemnification obligations set forth in Section 12.
6.1.1 Personal Auto Insurance — Important Warning
Personal automobile insurance policies in Canada commonly contain a "public liability" or "carrying passengers for compensation" exclusion that may void coverage when the vehicle is used to carry other people for any form of compensation — including a cost-sharing contribution that does not generate a profit for the Host. The scope of this exclusion varies by province, insurer, and policy, and the Insurance Bureau of Canada and provincial superintendents of insurance have published different and non-binding guidance on how it applies to peer-to-peer carpooling.
Before you post a route on Routebook, you should:
- Contact your insurer or broker and confirm, in writing, whether your policy covers cost-sharing carpool arrangements as described in these Terms;
- Ask whether a ride-sharing, car-sharing, or carpool endorsement is available on your policy, and whether purchasing such an endorsement is required to preserve coverage for your use of the Platform. Canadian carriers that offer such endorsements include (but are not limited to) Aviva, Intact, Economical, Co-operators, Desjardins, Belairdirect, and TD Insurance; availability, product form, and pricing differ by province and by carrier;
- In provinces served by a public insurer — British Columbia (ICBC), Saskatchewan (SGI), Manitoba (MPIC) — confirm with the public insurer whether your Autoplan, Auto Fund, or Autopac coverage applies to your intended use. Each public insurer publishes guidance on which types of ride-sharing require a specific permit, authorization, or product add-on;
- Reconsider whether to use the Platform if you cannot confirm coverage.
Routebook does not sell insurance, does not verify any user's insurance, and does not indemnify you if your personal insurer denies a claim on carrying-for-compensation grounds.
6.2 Prohibited Conduct
You agree not to use the Platform to:
- Post false, misleading, or deceptive content
- Impersonate any person or entity, or use a profile name that does not match your legal name in order to circumvent identity verification
- Submit fraudulent, altered, or borrowed documents during identity verification
- Harass, threaten, stalk, or intimidate any user
- Discriminate against any user on any ground prohibited by the Canadian Human Rights Act, R.S.C. 1985, c. H-6, or by the Human Rights Code of any Canadian province or territory. Prohibited grounds across Canadian jurisdictions include (without limitation): race, national or ethnic origin, colour, religion or creed, age, sex, sexual orientation, gender identity or expression, marital status, family status, genetic characteristics, disability (physical or mental), pardoned conviction, political belief, ancestry, place of origin, citizenship, source of income, and any other ground made a prohibited ground of discrimination by the applicable federal or provincial legislation in your jurisdiction
- Solicit or distribute illegal content
- Collect user data without consent, in violation of PIPEDA or any applicable provincial private-sector privacy legislation
- Use automated tools, bots, or scrapers
- Post or transmit malicious code
- Interfere with the Platform's operation or infrastructure
- Violate any applicable federal, provincial, territorial, or municipal law or regulation
- Use the Platform to operate an unlicensed commercial passenger-transportation service, Passenger Directed Vehicle, Transportation Network Services operation, limousine, taxi, or other for-hire transportation service
Violations may result in immediate account suspension and may be referred to law enforcement where appropriate.
7. Safety Is Your Responsibility
Routebook requires every user to complete government-ID verification via Persona before posting a route or requesting a seat (see Section 5.6). All users on the Platform have completed this check as a prerequisite to using the Platform. No verification badge is displayed on user profiles — verification is an access gate, not a public marker.
Verification confirms identity — it does not assess fitness to drive, criminal history, driving record, insurance status, vehicle condition, sobriety, or any other factor relevant to safety. Routebook does not perform background checks of any kind. Verification is not an endorsement or guarantee of safety.
Before choosing to travel with another user, you are solely responsible for:
- Determining whether you are comfortable with that person
- Verifying any information you consider material (licence, insurance, vehicle, etc.) directly with the other user
- Assessing the risks of traveling with a stranger
- Taking whatever safety precautions you consider appropriate
Routebook strongly encourages all users to exercise caution and good judgment. We recommend sharing your trip plans with a trusted third party before traveling with someone you have not previously met.
Insurance. Routebook does not provide or arrange any form of automobile insurance for users, vehicles, or trips arranged through the Platform. All automobile insurance is the responsibility of the user whose vehicle is being used for a given trip. Routebook does not verify whether any user holds automobile insurance, whether such insurance is currently in force, or whether the user's policy provides coverage during a trip arranged through the Platform. Personal automobile insurance policies issued in Canada may exclude coverage for peer-to-peer carpooling or ride-sharing use. You are solely responsible for satisfying yourself, before entering another user's vehicle, that you are comfortable with the arrangement and any associated risk.
Verification makes identity knowable. It does not make a trip safe. Safety is your responsibility.
8. Reviews and Ratings
After an interaction, users may leave ratings and reviews of other users. You agree that any review you submit:
- Reflects your honest, first-hand experience
- Does not contain false statements of fact (defamation at common law in Canada attaches to false statements of fact; expressions of opinion fairly based on disclosed facts are generally protected)
- Does not contain personal identifying information about other users
- Complies with our Community Guidelines
Routebook may remove reviews that violate these Terms at our discretion but has no obligation to do so.
9. Intellectual Property
9.1 Our IP
The Platform, including its design, code, trademarks, logos, and original content, is owned by or licensed to Routebook and protected by the Copyright Act (R.S.C. 1985, c. C-42), the Trademarks Act (R.S.C. 1985, c. T-13), and other applicable intellectual property laws. You may not copy, modify, reverse engineer, or create derivative works without our written permission.
9.2 Your Content
By submitting content to the Platform (including profile information, route postings, messages, and reviews), you grant Routebook a non-exclusive, worldwide, royalty-free, sublicensable licence to store, display, reproduce, modify, and use that content to operate and improve the Platform. You represent that you have all rights necessary to grant this licence, including (where applicable) consents under the Copyright Act and moral-rights waivers. You retain ownership of your content.
10. Disclaimers
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, ROUTEBOOK EXPRESSLY DISCLAIMS:
- ALL IMPLIED WARRANTIES AND CONDITIONS OF MERCHANTABILITY, MERCHANTABLE QUALITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED UNDER THE SALE OF GOODS ACT, THE PROVINCIAL CONSUMER PROTECTION STATUTES, AND APPLICABLE COMMON LAW
- ANY WARRANTY THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE
- ANY WARRANTY AS TO THE ACCURACY OR COMPLETENESS OF ANY CONTENT, ROUTE POSTING, OR USER PROFILE
- ANY WARRANTY REGARDING THE IDENTITY, QUALIFICATIONS, LICENSING, INSURANCE, CRIMINAL HISTORY, OR FITNESS OF ANY USER
- ANY WARRANTY THAT ANY TRAVEL ARRANGEMENT MADE THROUGH THE PLATFORM WILL BE COMPLETED, SAFE, LAWFUL, OR AS DESCRIBED
ROUTEBOOK MAKES NO REPRESENTATIONS ABOUT ANY OTHER USER OF THE PLATFORM. USER-ENTERED INFORMATION OTHER THAN GOVERNMENT-ID DOCUMENTS IS NOT VERIFIED BY ROUTEBOOK. GOVERNMENT-ID VERIFICATION PERFORMED BY PERSONA CONFIRMS DOCUMENT AUTHENTICITY AND SELFIE MATCH ONLY AND IS NOT A BACKGROUND CHECK OR AN ASSESSMENT OF ANY USER'S CHARACTER OR SAFETY.
11. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, ROUTEBOOK, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR:
- ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR AGGRAVATED DAMAGES ARISING FROM YOUR USE OF THE PLATFORM
- ANY LOSS OF DATA, PROFITS, REVENUE, OR GOODWILL
- ANY PERSONAL INJURY, PROPERTY DAMAGE, OR DEATH OCCURRING IN CONNECTION WITH ANY TRAVEL ARRANGEMENT MADE THROUGH THE PLATFORM
- ANY CONDUCT OR CONTENT OF OTHER USERS, WHETHER ONLINE OR OFFLINE
BECAUSE ROUTEBOOK DOES NOT PROVIDE TRANSPORTATION, DOES NOT EMPLOY OR SUPERVISE ANY USER, DOES NOT PERFORM BACKGROUND CHECKS OR ANY ASSESSMENT OF USER SAFETY BEYOND THE PERSONA DOCUMENT AND SELFIE VERIFICATION DESCRIBED IN SECTION 5.6, AND DOES NOT GUARANTEE ANY TRIP OR ARRANGEMENT:
FOR CLAIMS ARISING FROM OR RELATED TO THE CONDUCT OF A TRIP, THE CONDUCT OF ANY USER, OR ANY PERSONAL INJURY, PROPERTY DAMAGE, OR DEATH OCCURRING IN CONNECTION WITH A TRIP — ROUTEBOOK'S AGGREGATE LIABILITY SHALL NOT EXCEED ONE HUNDRED DOLLARS (CAD $100).
CERTAIN PROVINCES DO NOT ALLOW CERTAIN LIMITATIONS OF LIABILITY FOR PERSONAL INJURY OR CONSEQUENTIAL DAMAGES. IN THOSE PROVINCES, OUR LIABILITY SHALL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW. NOTHING IN THIS SECTION 11 LIMITS LIABILITY FOR FRAUD, FRAUDULENT MISREPRESENTATION, GROSS NEGLIGENCE, OR ANY LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.
12. Indemnification
You agree to indemnify, defend, and hold harmless Routebook and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees on a solicitor-and-own-client basis) arising out of or related to:
- Your use of the Platform
- Your violation of these Terms
- Your violation of any applicable law (including provincial transportation, insurance, consumer protection, or privacy legislation)
- Any travel arrangement you participate in through the Platform
- Any content you submit to the Platform
- Any dispute between you and another user
13. Dispute Resolution and Arbitration
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR RIGHT TO FILE A LAWSUIT IN COURT.
13.1 Informal Resolution
Before initiating any formal proceeding, you agree to contact Routebook at [email protected] and attempt in good faith to resolve the dispute informally for at least 30 days.
13.2 Binding Arbitration
If a dispute is not resolved informally, you and Routebook agree that any claim arising out of or relating to these Terms or the Platform will be resolved by binding individual arbitration administered by the ADR Institute of Canada, Inc. ("ADRIC") under its then-current Arbitration Rules, rather than in court. The seat of the arbitration shall be Toronto, Ontario, the language of the arbitration shall be English, and the governing procedural law shall be the Arbitration Act, 1991 (Ontario), S.O. 1991, c. 17. Each party shall bear its own costs of the arbitration except as the arbitrator orders otherwise.
13.3 Class Action Waiver
YOU AND ROUTEBOOK AGREE THAT EACH MAY BRING CLAIMS ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS, CONSOLIDATED, REPRESENTATIVE, OR GROUP PROCEEDING, INCLUDING ANY PROCEEDING UNDER THE CLASS PROCEEDINGS ACT, 1992 (ONTARIO) OR EQUIVALENT PROVINCIAL LEGISLATION.
13.4 Exceptions and Consumer-Protection Carve-Outs
Either party may seek emergency injunctive relief in any court of competent jurisdiction. Claims that qualify for small-claims court in your province or territory are excluded from mandatory arbitration.
Nothing in Sections 13.2 or 13.3 prevents you from asserting any non-waivable right under the consumer-protection legislation of your province or territory, including the Ontario Consumer Protection Act, 2002 (S.O. 2002, c. 30, Sch. A), the British Columbia Business Practices and Consumer Protection Act (S.B.C. 2004, c. 2), the Alberta Consumer Protection Act (R.S.A. 2000, c. C-26.3), the Quebec Consumer Protection Act (CQLR c. P-40.1) if applicable, or any equivalent legislation that confers a right to proceed in court or to join a class or representative proceeding on behalf of consumers. Where provincial legislation renders a mandatory-arbitration or class-waiver provision unenforceable with respect to a specific dispute, this Section 13 shall not apply to that dispute to the extent of the unenforceability.
13.5 Opt-Out Right
You may opt out of the arbitration agreement and class action waiver in Sections 13.2–13.3 by sending written notice to [email protected] within 30 days of first accepting these Terms. Your notice must include your full legal name, the email address associated with your account, and the statement: "I opt out of the Routebook arbitration and class waiver provisions." Opting out does not affect any other portion of these Terms and does not affect Routebook's other services or your ability to use the Platform.
13.6 Governing Law and Venue

15.6 Platform Operator; Third-Party Accounts
The Platform is owned and operated by RouteBook LLC, a limited liability company organized under the laws of the State of Delaware, United States. All rights, obligations, revenues, expenses, and liabilities arising from the operation of the Platform belong to RouteBook LLC, and not to any individual member, officer, employee, or founder of RouteBook LLC.
Certain third-party accounts, memberships, and registrations required for the operation of the Platform — including but not limited to the Apple Developer Program membership under which the Routebook mobile application is distributed, and any related developer, publisher, or vendor accounts — may, due to the policies of the applicable third-party provider, be registered in the name of an individual founder or member of RouteBook LLC rather than in the name of RouteBook LLC directly. Any such account is held by that individual solely as nominee and trustee for the sole benefit of RouteBook LLC. All fees paid, revenues received, obligations incurred, and rights arising under such accounts are, and at all times have been, the property and responsibility of RouteBook LLC.
No individual who holds any such third-party account in a nominee capacity is a party to these Terms, is the operator of the Platform, or has any personal liability to any user arising from or relating to the Platform, and no user shall have any claim against any such individual in his or her personal capacity based on the operation of the Platform.
15.7 Language
For users in Quebec, the applicable French version of these Terms must be provided before acceptance. A user may agree to an English version only after receiving the French version and expressly choosing to contract in English, as permitted by the Charter of the French Language. Related contract documents will be handled in accordance with that law. Nothing in this section limits any rights that cannot lawfully be waived.
